Present Case Is Offer A Legal Advice Frank ââ¬Myassignmenthelp.Com
Question: Talk About The Present Case Is Offer A Legal Advice Frank? Answer: Introducation Office is a unique sort of financialagreement between the two gatherings where one gathering called as chief has stretched out some lawful position to other gathering called specialist to make legitimate agreement with the outsider in the interest of the head. Consequently, it tends to be said in organization law for the most part three gatherings are included for example Head, operator, outsider (Pont, 2008). At the point when specialist with adequate authority has sanctioned an agreement with the outsider, at that point in such cases the legally binding commitment gets official on the head. The chief is obligated to satisfy the authoritative obligations for the outsider just when the specialist who has authorized the agreement with the outsider has the essential power (Cassidy, 2013). On the off chance that any of the underneath featured position exists with the operator, at that point the legally binding risk is legitimate on head. Standard/Actual position (Express Implied power) Authority of need Apparent/evident position Real position At the point when the chief has stretched out the position to specialist in composed structure or in oral structure, at that point it would be named as express power. Further, when the chief doesn't in reality express the power however has broadened the position/assignment/title to play out some work, at that point in such cases it has been expected that specialist has the approval to play out the work in the interest of the head (Edlin, 2007). The main case in this respects is Watteau v Fenwick[1893] 1 QB 346 case. In such cases, it is basic that the particular chief hosts educated the third gatherings with respect to the degree of approval of the specialist (Harris, 2014). Apparent/evident position In such power, the chief doesn't expect to offer position to specialist however because of his activity the outsider accept that the operator has approval. The direct speaks to that the specialist has lawful power to order the agreement with outsider and thus in such cases, the legally binding commitment is relevant on head. Freeman Lockyer v Buckhurst Park Properties[1964] 1 All ER 630 case is the declaration of this perspective (Pathinayake, 2014). Authority of need The operator has played out certain demonstrations with the outsider so as to secure the enthusiasm of the head. The judgment given in Great Northern Railway Co. vSwaffield(1874)LR 9 Ex 132 case is the case of organization of need. At the point when any of the above power isn't stretched out by the head to the operator, at that point in such cases, Management isn't subject to finish the legally binding commitment with the outsider. The Yonge v Toynbee[1910] 1 KB 215 case is the declaration of this. There are a few obligations of the trustee gatherings of the organization relationship which are outfitted underneath (Pont, 2008): Obligation of specialist towards the head Adheres to the guidance of head In the event that not, at that point the chief has legitimate rights to recuperate the harms from specialist or sue operator) Guardian obligation It is crucial that specialists lead must demonstrate great confidence of the head. The fundamental elements are demonstrated as follows (Harvey, 2009): On the off chance that it has been discovered that operator has made agreement for his own advantage, at that point chief can sue specialist and case for harms as given in Christie v Harcourt[1973] 2 NZLR 139 case. Operator should make mystery benefit in the interest of chief as featured in Bentley v Craven(1853) 52 ER 29 case. Abuse of classified data by the operator according to Robb v Green[1895] 2 QB 315 case. In the event that the specialist has penetrated the trustee obligations, at that point chief has the privileges to sue the operator and recoup the misfortunes. It is important that when the chief hosts not educated the third get-together in regards to the withdrawal of any authority from the specialist and the operator has instituted the agreement with the outsider, at that point in such cases the enthusiasm of the outsider would be ensured under custom-based law. Likewise, the chief is at risk to fulfill the legally binding commitments coordinated towards the outsider. On the off chance that chief denies doing as such, at that point the outsider can sue the head or guarantee for the harms (Edlin, 2007). Application It is obvious from the case realities that Frank (the head) has selected Gemma as a sales rep for his shop. Gemma is functioning as a business specialist for Frank which implies she has the power to offer the apparatuses to clients for the benefit of Frank. Likewise, Tom is the client who is prepared to purchase a dishwasher for $350 has educated Gemma about the equivalent. Notwithstanding, Gemma has called her niece and has sold her dishwasher for $300. She doesn't illuminate Frank about this case and later on Tom has educated about the equivalent to Frank. It very well may be seen that Gemmas has led the work for individual intrigue and has penetrated the trustee obligation. In this manner, Frank can recoup the harm of $50 from her. It is evident that Frank has approved Bob to sell clothes washers and to sanction contract with laundries. Be that as it may, because of Bobs late coming and drinking propensity, Frank has terminated Bob from work. Further, Frank hosts neglected to educate the third get-together Angela in regards to the withdrawal of obligations from Bob. Henceforth, Angela didn't know that Bob doesn't have the imperative approval and thus, she established the agreement under great confidence consequently moving $10,000. Additionally, it is observable that Bob has the express position to act bookkeeping to Angela. In this way, Frank needs to finish the authoritative obligation or, in all likelihood Angela can sue him for penetrating the agreement. End It very well may be closed from the over that Frank can sue Gemma for breaking the trustee obligations and working for advancing her own advantage. Subsequently, Frank can recuperate the harm of $50 from Gemma. In second case, Frank doesn't educate Angela in regards to the withdrawal of approval from Bob. Accordingly, Frank is limited with the authoritative commitments with Angela which was entered by her in compliance with common decency. Reference Cassidy, J. (2013). States that Require the ACT or SAT
If you werent sure whether to take the SAT or ACT, heres some good (?) news: your state may already have decided for you! Thats right as states begin to use college admissions tests to meet national standards required of public high schools, theyre starting to make the ACT/SAT mandatory. One upside of this? Because of this change, some states have already begun to provide the ACT or the SAT free to all juniors (more on this in a second). An important reminder that state and local policies change rapidly. This information is correct at the time of publication (May 2017), but you should check with your guidance counselor to confirm state requirements and subsidies! So just where do you lucky students who experience (or will experience) mandatory college admissions testing live? Which are the states that require the ACT? Which are the states that require the SAT? Well, take a look at the map above or the chart below to find out what your state requires! States that Require the ACT or SAT StateRequired Test AlabamaACT ColoradoSAT ConnecticutSAT DelawareSAT District of ColumbiaSAT HawaiiACT IdahoSAT or ACT IllinoisSAT KentuckyACT LouisianaACT MaineSAT MichiganSAT MississippiACT MissouriACT MontanaACT NebraskaACT NevadaACT New HampshireSAT North CarolinaACT OhioSAT or ACT South CarolinaACT TennesseeSAT or ACT UtahACT WisconsinACT WyomingACT Data adapted from Education Week Who Pays? Things start to get pretty complicated once you start asking the big question: Do I have to pay for a test that Im required by law to take? In most cases: no, you dont. In fact, some states that require the ACT will even let you take the SAT for free (and some states that require the SAT will let you take the ACT for free), giving you a great leg up for college admissions! Some states, however, just dont have it in their budgets (or are being a little stingy!) and youll have to pay for this required test yourself. I know. Sorry. The other big question is What if Id do better on the test my states not requiring? In that case: yes, youll have to take both tests. But some states will pay for the other test, as well, or even give you a choice between the tests (Oklahoma, anyone?) Because all of these requirements and subsidies could make anyones eyes cross, weve gone ahead and put together a map that tells you exactly what your state requires and will pay for (as of May 2017!) Find your state here: My State Is Grey. Whats Up? If your states grey on the map above, congrats! You are not (currently) legally required to take either the SAT or the ACT. Also, sorry! Your state will not pay for you to take either the ACT for free or the SAT for free (though your school district mightand there are subsidies for lower-income studentstalk to your guidance counselor). But rememberstate and local education policies change all the time. So thats not to say that you wont be required/able to take the ACT or SAT for free at some point in the future. A Final Word on States that Require the ACT (and States that Require the SAT) At the end of the day, are there benefits to state-mandated college admissions testing? Definitely, though it may not feel like it when you learn the news. In the first place, if youre planning on going to college, this gives you a concrete deadline so you can start preparing for the exam. It may show you that youll do better on one test than the other. It also gives you a (usually) free opportunity to polish your test-taking skills and get your first test out of the way (most students do better on their second exam). If you werent planning on going to college, this trend takes away one of the barriers that might have been preventing you from doing so (either because of the cost or the time involved) and will hopefully show you that you do have what it takes to succeed in college, if thats what you choose to pursue! So three cheers all around, and heres hoping that those grey states start changing their tune!

But What Do You Mean - 751 Words
In the essay, ââ¬Å"But What Do You Mean?â⬠author and linguistic expert Deborah Tannen argues her feelings on how men and women vary in their use of conversational ââ¬Å"rituals.â⬠She states that males have a tendency to use wording to sustain dominance in conversation; however, women seem to take in to account the feelings of others. Tannen identifies seven categories in which men and women differ in communication. First, women use apologies to assure other people. Men can misapprehend these apologies as taking blame rather than as the ritual reassurance that women mean for it to be perceived. This supports what Tannen says in her essay, ââ¬Å"But there are times when ââ¬ËIââ¬â¢m sorryââ¬â¢ isnââ¬â¢t self-deprecating or even an apologyâ⬠(Tannen 380). Second, men are more straight-forward when criticizing more than women; women ââ¬Å"softenâ⬠their criticism with the purpose of sparing the feelings of the person they are criticizing. Third, women often say ââ¬Å"thank youâ⬠ritualistically, most of the time to equate the two in the conversation. Fourth, men enjoy ââ¬Å"verbally sparringâ⬠more than women. Because of this difference, women are under the impression that they are usually condemned in a conversation. Fifth, women and men use praise differently. Women tend to expect praise open-heartedly when they are praised. Men, on the other hand, often confuse that not criticizing is praise enough. Sixth, women converse their complications in order to share their experiences; they complain not to solve theirShow MoreRelatedWhat Do You Mean?1076 Words à |à 5 Pagesââ¬Å"I know itââ¬â¢s a lot to take in. but hey at least it explains for a lot of things right? Federalism and Poverty Essay Example For Students
Federalism and Poverty Essay Federalism and Poverty Essay in the United States Many Americans believe that the federal government is too big, both in the number of agencies it directs and in the scope of its powers. Some people also think that the daily business of Capitol Hill has no effect on their lives, in part because they believe that politicians do not understand their problems. This dissatisfaction with Washington, D.C., in recent years has renewed debate over the division of power between federal and state and local governments. Federalismthe sharing of power between the states and the national governmenthas been a major issue throughout U.S. history. Thomas R. Dye defines federalism as a division of power between two separate authoritiesthe nation and the stateseach of which enforces its own laws directly on its citizens (Dye, 1999, p.98). When the U.S. Constitution established the federal government in 1787, it only exercised limited or enumerated powers, such as making treaties and printing money. The Tenth Amendment of the Bill of Rights, ratified in 1791, clarified that all other powers belonged to the states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people, (U.S. Const. , 1791, Amend. 10). Over the years, in response to national crisis, many of the governments powers, particularly those over social programs, were centralized to the federal level. However, in recent years, an increasing number of people on Capitol Hill and across the country want to devolve, or transfer, power from Washington, D.C. to state and local governments. After the 1994 elections, the Republican majority in Congress pursued the devolution agenda as part of the partys Contract with America. According to Michael S. Greve, One crown jewel of the devolution campaignwas the 1996 welfare reform, which replaced the federal Aid to Families with Dependent Children program, a set of very stringent, categorical federal requirements, with block grants to the states (Greve, 1999,p. 120). Within general federal guidelines, the states are permitted to design and implement their own welfare programs. State governments are largely responsible for managing the budgets and enforcing the laws in many policy areas, such as poverty and education. Many members of Congress want the states to take on even greater authority in these areas and other, including environmental protection and crime control. Some experts believe that state governments will be able to tackle these problems more effectively and efficiently than Washington. Others, however, doubt that the federal government will provide adequate funds and worry that some states do not have the necessary infrastructure to offer adequate services. Before the Great Depression, aid to the poor came mostly from churches and charity organizations. When millions of Americans fell into poverty in the 1930s, however, charities and state governments were not financially equipped to provide for the needy, and there was no federal policy in place to provide aid to low-income people. President Franklin Roosevelt and Congress wrote landmark legislation, known collectively as the New Deal, to combat the effects of the Great Depression. The new legislation included massive job programs that provided work for unemployed Americans. Other programs, like Aid to Families with Dependent Children and Social Security, offered financial assistance to people who could not work because of family responsibilities, age, or disability. This legislation also marked the beginning of an era of centralization; control over many services became more concentrated in the federal government. The legacy of Roosevelts New Deal continued with President Lyndon Johnsons War on Poverty three decades later. In 1964, in the annual message to the Congress on the State of the Union, President Johnson declared that no society could be great with poverty in its midst (Johnson, 1964). Johnson implemented social programs designed to eliminate poverty by moving people up the social ladder through vocational education and job training. He also promoted programs, such as food stamps, Medicare, and Medicaid, to help poor and older Americans get enough food and adequate health care. Johnson called his plan the Great Society. President Richard Nixon advanced many of the New Deal and Great Society programs by establishing the Supplemental Security Income program and expanding the food stamp program. .ue94eed9f5753f25c7369adf2d2eda08b , .ue94eed9f5753f25c7369adf2d2eda08b .postImageUrl , .ue94eed9f5753f25c7369adf2d2eda08b .centered-text-area { min-height: 80px; position: relative; } .ue94eed9f5753f25c7369adf2d2eda08b , .ue94eed9f5753f25c7369adf2d2eda08b:hover , .ue94eed9f5753f25c7369adf2d2eda08b:visited , .ue94eed9f5753f25c7369adf2d2eda08b:active { border:0!important; } .ue94eed9f5753f25c7369adf2d2eda08b .clearfix:after { content: ""; display: table; clear: both; } .ue94eed9f5753f25c7369adf2d2eda08b { display: block; transition: background-color 250ms; webkit-transition: background-color 250ms; width: 100%; opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #95A5A6; } .ue94eed9f5753f25c7369adf2d2eda08b:active , .ue94eed9f5753f25c7369adf2d2eda08b:hover { opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #2C3E50; } .ue94eed9f5753f25c7369adf2d2eda08b .centered-text-area { width: 100%; position: relative ; } .ue94eed9f5753f25c7369adf2d2eda08b .ctaText { border-bottom: 0 solid #fff; color: #2980B9; font-size: 16px; font-weight: bold; margin: 0; padding: 0; text-decoration: underline; } .ue94eed9f5753f25c7369adf2d2eda08b .postTitle { color: #FFFFFF; font-size: 16px; font-weight: 600; margin: 0; padding: 0; width: 100%; } .ue94eed9f5753f25c7369adf2d2eda08b .ctaButton { background-color: #7F8C8D!important; color: #2980B9; border: none; border-radius: 3px; box-shadow: none; font-size: 14px; font-weight: bold; line-height: 26px; moz-border-radius: 3px; text-align: center; text-decoration: none; text-shadow: none; width: 80px; min-height: 80px; background: url(https://artscolumbia.org/wp-content/plugins/intelly-related-posts/assets/images/simple-arrow.png)no-repeat; position: absolute; right: 0; top: 0; } .ue94eed9f5753f25c7369adf2d2eda08b:hover .ctaButton { background-color: #34495E!important; } .ue94eed9f5753f25c7369adf2d2eda08b .centered-text { display: table; height: 80px; padding-left : 18px; top: 0; } .ue94eed9f5753f25c7369adf2d2eda08b .ue94eed9f5753f25c7369adf2d2eda08b-content { display: table-cell; margin: 0; padding: 0; padding-right: 108px; position: relative; vertical-align: middle; width: 100%; } .ue94eed9f5753f25c7369adf2d2eda08b:after { content: ""; display: block; clear: both; } READ: Tragic Hero Antigone Essay Alice Rivilin wrote, President Nixon was attracted .

Mutual Funds Essays - Investment, Funds, Financial Services
Mutual Funds Mutual Funds A mutual fund is a large pool of money that investors create which is used to buy many different stocks, rather than just buying an individual stock. Because all these investors have combined their money, they can afford to buy many different stocks. A mutual fund is managed by a portfolio manager. He or she controls all of the investors' money and invest it into a group of stocks or bonds and decides how much to invest in each stock. A mutual fund has a price, like a stock (Net Asset Value). It tells you how much one share of that mutual fund costs. When you buy stock, you have to pay a commission. However, the fees involved with investing in a mutual fund are often much less in comparison. There are currently over 6,000 mutual funds available to investors and each one has its own unique style of investing. Here are some of the funds that you may want to consider: Balanced Fund: These funds are probably best for conservative investors (those who try to minimize their risk). These funds often invest in many different stocks and bonds. Some balanced funds invest in over 200 stocks. By doing this, they minimize your risk while also providing fairly stable growth. Dividend Growth: These mutual funds use a special kind of investing strategy. They look for stocks that pay dividends and determine the health of the company by seeing how fast the dividend payments are growing. When a company is doing well, it often raises its dividends. The fund managers look at these as the key factor in deciding which stocks to buy. Companies that pay dividends are often large, well-established companies. Therefore, dividend growth funds are fairly safe investments but they also provide quite a bit of growth. Capitalization Funds: These funds invest in companies whose market capitalization (the total value of all of their stock) falls into their area. Small-cap stocks are those that have market caps of less than $1 billion. Mid-cap stocks are those with market caps in the range of $1-5 billion. Large-cap stocks are those with market capitalizations of at least $5 billion. Index funds: are seen as the best type of mutual funds to invest in because they outperform 85% of all mutual funds. These funds invest in stocks that make up stock indexes such as the S&P 500. These funds also have fewer fees because they buy and sell stocks less often. Also, because they sell stocks less often, the capital gains are usually seen as long-term so you will pay less when tax season comes around. Mutual funds are great for people who don't want to take as much risk with their money. Mutual funds are less risky because they buy a bunch of stocks. If one stock does poorly, you won't lose as much money as you would if that was the only stock you owned. Mutual funds are also good for people who don't want to spend too much time investing Many people who want to invest are somewhat afraid to actually do it. Investing is an important step to becoming rich in the long-term so mutual funds offer a safer way to reach your goals. I think everyone should invest in mutual funds instead of buying stocks because stocks aren't always as safe as mutual funds and I think everyone should invest as early as possible. Business

Free Essays on Judging A Book By Its Cover Free Essays on Judging A Book By Its Cover Judging A Book By Its Cover Beginning as early as birth, children are taught to judge a book by its cover and yet they are told otherwise. They are taught that boys like blue and boys go pee- pee in the room with the stick figure wearing the pants. Whereas girls like pink and they wear the dresses. Solution - Essay Example 2014). Content marketing targets attracting and retaining the customers of a business through continuous creation and development of content which are focused on changing the behaviour of the consumers (What is Content Marketing? 2014). The contents for content marketing have to be in association with the particular needs of the business, which would essentially vary from one company to another. Hence in order to achieve successful content marketing, the goals of the business have to be clearly set and planned (Baer, 2014). This step involves identifying the audience to whom the content would be targeted. There should be a particular aim of the execution of a particular content. Hence in this step, the business organization needs to identify the aim or the purpose that the business wants the content to fulfil (Baer, 2014). This is the step where the business needs to identify what it is producing, when, and for whom. This is extremely important since the content will have to be based on this information. The information and the audience have to be connected through the content being developed (Baer, 2014). Atomization would involve considering a key or a major idea related to the business, and executing smaller contents from the big concept. This is a form of reinvention which would help the business to create innovative contents for its purpose of marketing (Baer, 2014). This step suggests that the content marketing needs to be marketed by the business. Contents cannot be just created and people be attracted. Content executions will have to be created such as the product, and they will be required to be launched in the market like a business would do with a product. Integrated marketing tactics need to be followed for this purpose to bring the contents in front of the public (Baer, 2014). Contents are more effective for marketing if they are measured. By this it is meant that the business needs to measure

Problems in sales and marketing and make recommendations&benefits Assignment
Problems in sales and marketing and make recommendations&benefits - Assignment Example In addition to that, the strategy of allowing the customers too much leeway regarding payment may make the organization to lose out on potential sales for new stock because it is highly unlikely that the customers who have not paid for purchased products will come back to purchase more. The company may subsequently find it more difficult to plan for its future operations (Espejo, 2010, 68). From the responses, it is evident that the organization does not have a concrete strategy for selling and marketing its products. This lack of strategy reflects on the sales and profits that the organization makes. The company advertises its products on different forms of media, the most preferred one by the company being the print media. However, the company does not market its product online. With the advent of technology as a tool for sales and marketing, the Secret Squirrel Company stands to make more sales and subsequent profits by advertising online (Ryan & Jones, 2009, 18). The company loses out on sales made to customers online, therefore limiting its own sources of revenue. It is also notable that the company spends the bulk of its budgetary allocation for advertising on print media advertisements. The Secret Squirrel Company spends more than $2 000 000 on print media advertising, while not spending as much on more visible media for advertising such as television and billboards (Stinson, 2008, 42). The company limits its exposure by spending so much on advertising on print media, such that the company neglects the ability of television and radio to attract potential consumers of the organizationââ¬â¢s products (Jeannet & Hennessey, 2004, 117). Both the Sales and Marketing managers do not have enough information regarding the products that the organization sells. This does not help the organization to maximize sales, considering that the two should have the most information concerning the companyââ¬â¢s products since they head these critical departments at

Nature vs Nurture Essay -- Arguementative Essays
Nature vs Nurture Most of us have an intuition that, although our genes provide advantages and constraints, we retain great control over our lives. However, we are developing a second, competing intuition that, like it or not, our genes determine our abilities, our preferences, and our emotions. We would like to think we are much more than the sum of our genes, but scientists have apparently demonstrated that our genes determine some of our most complex behavioral and cognitive characteristics. The focus on genes as the primary mode of biological explanation has been especially clear in the marketing of the Human Genome Project. In support of this project, Robert L. Sinsheimer, biologist and former chancellor at the University of California, Santa Cruz, affirmed, "[i]n the deepest sense we are who we are because of our genes." (Berkowitz 1996) Does the available scientific evidence actually tell us that our genes determine our behavioural, emotional, and cognitive characteristics? Do single genes specify particular behavioural traits? To answer these questions, most non-scientists depend upon the cursory reports of new research findings that appear regularly in the lay press. These reports are oversimplified and may be shaped by the desire of both journalists and scientists to create an exciting story. As a result, our perceptions of the scientific evidence may be skewed by a few dramatic findings, some of which may be wrong. Nowhere has this been more clear than in the representation of the roles of genes in determining uniquely human characteristics, involving our thoughts, emotions, and behaviours. Patient and Hybrid Record Essay
1. What is the potential impact of the copy/paste functionality on the integrity of the data and information contained in an EHR? The copy/paste function opens the possibility for fraud, medical error and risk for malpractice claims. Fraud could occur when a copy/paste function is used and than an insurance company is billed for the procedure/services 2 or 3 times. When in reality the procedure/service was only completed once. Medical error can occur with the copy/paste function, when a nurse reads a chart made by a doctor who copy/pasted instructions or initiates a procedure that was already completed but the doctor didnââ¬â¢t realize that they copy/pasted it again. Than the nurse completes the procedure again, which can have fatal results. Thus opening the door for malpractice and even criminal suits. Thus the integrity of the whole file would have been compromised by on click of a button. 2. How does copy/paste functionality affect reimbursement? The copy/paste function can affect reimbursement because your insurance could get billed several times for the same procedure that was only completed once. Than your insurance could potentially deny the whole procedure leaving you with the bill and the headache of getting it sorted out. The other side of the coin is that with copy/paste function being used could make it to where someone elseââ¬â¢s insurance gets billed if the last copied document is from anotherââ¬â¢s file than they clicked onto your file and though they highlighted something new but didnââ¬â¢t causing a whole new set of problems. 3. What measures can a hospital take to improve data integrity in their EHR while still achieving their goal of streamlining the documentation process? There needs to be educational training on the functionality of the copy/paste function and when and where it should and should not be used. EHR professionals need to come up with some new software applications that would cut down on the amount of functions that can be implemented into one document without a review by a trained professional. New better software and proper training is the way to go in my opinion. Donââ¬â¢t let staff get lazy and complacent with using the copy/paste function. 1. What impact can a hybrid record have on patient care? The hybrid record could have negative and positive effects on patient care. One negative effect would be that it would take longer to access and put together if a whole file is requested. Another negative would be just where exactly is all of these paper records being kept. A positive effect of the hybrid record is that if the computer system is compromised in some way there would be a paper record. 2. How might the hybrid record change health information management? The hybrid record would change health information management because you would have to have employees to care for all these records, as well as employees for the computer files thus creating more staff and costing more. There would of course have to be training on how to properly handle the hybrid record having thus an effect on the health information management team. Who would have to implement training, schedule personnel off to take the training find yet others to cover for that training. Again costing more money and time. 3. How might a hospital overcome some of the issues created by the hybrid record? To overcome some issues created by the hybrid record you would have to have good education/training in implementation of new data, new software and soft- ware development. Different sections of the hospital should help in the development of software that would be beneficial to the entire hospital or clinic, so that no one section is left out of the decision process, so all need are attempted to be met. Educate not only the HIM staff but the hospital or clinic as a whole so that everyone knows where things are kept and how they are stored.

Relationship of the United States and Japan
The earliest contact between both countries was through merchants and explorers. Later in the mid-1800s several representatives from the U.S. traveled to Japan in order to negotiate trade agreements, including Commodore Matthew Perry in 1852 who negotiated the first trade treaty and the Convention of Kanagawa. Likewise, a Japanese delegation came to the U.S. in 1860 in hopes of strengthening diplomatic and trade relations between both countries. World War II World War II saw the countries pitted against each other after the Japanese bombed the American naval base atà Pearl Harbor, Hawaii, in 1941. The war ended in 1945 after Japan suffered tremendous causalities from the atomic bombing of Hiroshima and Nagasaki and the firebombing of Tokyo. Korean War Both China and the US got involved in the Korean War in support of the North and the South respectively. This was the only time when soldiers from both countries actually fought as the U.S./U.N. forces battled Chinese soldiers upon Chinas official entrance in the war to counter American involvement. Surrender On August 14, 1945, Japan surrendered leading to an occupation by the victorious Allied forces. Upon gaining control of Japan, U.S. President Harry Truman appointed General Douglas MacArthur as Supreme Commander of the Allied Powers in Japan. The Allied forces worked on the reconstruction of Japan, as well as consolidating political legitimacy by publicly standing on the side of Emperor Hirohito. This allowed MacArthur to work within the political system. By the end of 1945, approximately 350,000 U.S. servicemen were in Japan working on a wide variety of projects. Post War Transformation Under Allied control, Japan undertook a remarkable transformation characterized by the new constitution of Japan which emphasized democratic principles, educational and economic reform, and demilitarization which was embedded in the new Japanese constitution. As the reforms took place MacArthur gradually shifted political control over to the Japanese culminating in the 1952 Treaty of San Francisco which officially ended the occupation. This framework was the beginning of a close relationship between both countries that lasts until this day. Close Cooperation The period after the San Francisco treaty has been characterized by close cooperation between both countries, with 47,000 US military servicemen remaining in Japan by invitation of the Japanese government. Economic cooperation has also been playing a large role in the relationship with the US providing Japan with significant amounts of aid in the post-war periods as Japan became an ally in the Cold War. The partnership has resulted in the reemergence of the Japanese economy which remains one of the strongest economies in the region.

The Centers for Disease Control and Prevention (CDC) works with the National Center for Health Statistics Data (NCHS) each year to conduct the National Health and Nutrition Examination Survey (NHANES), which provides us with data on the prevalence of obesity in the United States. For the years 2013-2014, it is noted that more than 2 in 3 adults (70.2 percent) were considered to be overweight or have obesity. Numbers since then have been on the rise. Donââ¬â¢t waste time! Our writers will create an original "Do Supplements in Diets for Weight Loss Really Work?" essay for you Create order With such high prevalence of obesity, over half of us report being on a diet. The Council for Responsible Nutrition (CRN) states that the majority of those who report being on a diet ââ¬â 68 percent ââ¬â take dietary supplements and that this percentage has remained consistent over the past five years. Consumer surveys conducted by the CRN show that most supplement users aged 18-34 ââ¬â 66 percent ââ¬â anticipate their supplement use will increase over the next five years. According to the Office of Dietary Supplements at the National Institutes of Health, Americans spend over $25 billion per year on more than 50,000 products containing vitamins and minerals, herbs and botanicals, and other ingredients such as glucosamine, fish oils, and probiotics. Should Americans be using these supplements for weight loss? Do they really help us lose weight and are they safe to use? FDA REGULATION Dietary supplements are available in a variety of different forms from pills, capsules, and gel tablets, to powders, extracts, and liquids. There are hundreds of herbal supplements and over-the-counter drugs that dont require a prescription from a healthcare provider. Most Americans believe that what they find on the shelves of their local convenience store or pharmacy is trustworthy, effective, and safe to use. The scary truth is that many over-the-counter drugs and herbal supplements are not regulated by the Food and Drug Administration (FDA). Without FDA regulation, a lot of what we know about the drug or supplement is unknown including facts on its effectiveness, measurements of the active ingredient(s), and if any harmful substances are used or included. In fact, recent FDA investigations have found that nearly 70 kinds of diet pills were spiked, laced, and flooded with dangerous drugs. The only drugs that promise FDA regulation are prescription medications, drugs prescribed by a physician. There are over a dozen different prescription weight loss drugs on the pharmaceutical market and even though they are FDA regulated, doctors are still leery to prescribe them. This is because failure to follow a physicians exact instructions or taking too much of a weight loss prescription medication has been proven to lead to sleep problems, palpitations, an increased heart rate, stroke, and even heart attacks. Because of this risk, physicians will only prescribe weight loss medications to those who have a body mass index (BMI) greater than 30 or those who have a BMI of 27 and a comorbidity such as hypertension, high cholesterol, or diabetes. CLINICALLY MEANINGFUL During a 2016 study of 28 long-term trials of prescription drugs used for the treatment of obesity, researchers confessed that a person taking a prescription weight-loss drug while making appropriate lifestyle changes, only increases their likelihood of achieving clinically meaningful weight loss within a year. In research, clinically meaningful weight loss is generally defined as 5 percent or more of body weight, meaning only enough weight has been lost to lower ones risk of heart disease, diabetes, or other weight related health diseases. THE FACTS Ann Thurn, director of the Office of Dietary Supplements communications program at the National Institutes of Health (NIH), says that People may not know that many manufacturers of weight-loss supplements dont conduct studies in humans to find out whether their product works and is safe. For example, the ingredient chromium, may help people lose a very small amount of weight and body fat, and is safe; but another ingredient, raspberry ketones, havent been studied enough to know whether theyre safe or effective. Consumers should keep in mind that many supplements contain more than one ingredient, and these combinations often have not been studied for their safety or effectiveness. We encourage people to talk with their health care providers to get advice about dietary supplements and to visit the ODS website to learn valuable information about these products. The NIH assembles fact sheets on the ingredients in exercise supplements and dietary supplements that manufacturers have cl aimed produce increased performance and/or increased weight loss. These fact sheets list everything that is known about a supplements safety and effectiveness and are available to the public. HERBAL SUPPLEMENTS Hoodia is an herbal supplement, plant-derived, and available in pill, liquid, and lollipop forms. Its grown naturally in Botswana, South Africa and Namibia and was originally used by African leaders when going on long journeys to hunt or wage war. The substance tricks your body into believing you have enough fuel and do not need to eat any more food by increasing the amount of energy in the brain. The herbal supplement has been sold in the United States ââ¬â and in the last year ââ¬â more than it has ever been grown in African countries. Its become so popular that one manufacturer, which made the drug available in milk chocolate chews, claims to have acquired $20 million in a year. A 30-day supply found in health food stores often costs consumers around $35. Despite its popularity and soaring internet sales, the South African appetite suppressant has few to almost none published, scientific studies that support the promise of weight loss. In fact, only one laboratory s tudy has been used as evidence. This evidence, produced by David MacLean, MD, an adjunct associate professor at Brown University and a former researcher at Pfizer ââ¬â a pharmaceutical company ââ¬â reported, that a molecule in hoodia, called P57, likely has an effect on the brains hypothalamus, which helps regulate appetite. He goes on to state that his study was done and tested strictly in animals. Another herbal supplement that has gained popularity in the United States over the years is bitter orange. Its effects are similar to synephrine, an increase in energy and a reduction in appetite. But what most claims fail to note is that synephrine is a natural chemical that is released when we need to run from real, imminent danger. This type of chemical is not appropriate or safe to put freely into our bodies due to its side effects of increasingly high blood pressure ââ¬â enough to cause a stroke. OVER-THE-COUNTER DRUGS Over-the-counter drugs can also mislead us into believing they are safe and effective to use for weight loss. For example, orlistat, the only product that is FDA approved, stops our bodies from absorbing calories. It does so by coating our intestines with enzymes that disable our bodies from absorbing fat. Therefore, no fat absorption means no calories can be absorbed. So, whats the catch? Lets say you eat a plate of cheese fries, or nachos, doing so will overload the enzyme-stopping system, resulting in bloating, gas and oily, loose, and frequent stools. The only way to avoid this messy complication is to keep your total fat intake under 30% or less. High-fiber supplements and psyllium husks are also recommended to aid in the digestive process and avoid the complication. The worst part? Orlistat inhibits our bodys ability to absorb essential vitamins ââ¬â vitamin A, D, and E ââ¬â so multivitamins must also be taken (in addition to high-fiber supplements, psyllium hu sks, and a total fat intake of less than 30%) if you choose to use this over-the-counter drug. VITAMINS FOR THE WIN Authors, Arielle Levitan, MD, and Romy Block, MD, state in their book The Vitamin Solution: Two Doctors Clear the Confusion About Vitamins and Your Health, As part of a healthy living plan that includes clean eating, exercise, and stress management, we find that vitamins and minerals can play a role in weight loss and weight management. Many, if not most of us, have nutrient needs that are unmet by diet alone. When we replenish these deficiencies with the right vitamins and minerals, in proper doses, then we can satisfy our bodys nutrient cravings and in turn, reduce our unhealthy eating. They go on say that patients report better sleeping patterns, increased energy, better exercise habits, less of an appetite, and healthier food choices. So which vitamins are the most effective? VITAMIN D The American Journal of Clinical Nutrition published a study that found that overweight and obese adults taking vitamin D supplements in conjunction with calcium lost a significantly more amount of stomach fact versus people who were not taking any supplements. Being vitamin D deficient causes our body to convert sugar to fat, instead of energy, resulting in easy weight gain. Also, overweight and obese individuals ââ¬â especially those that are physically inactive have lower vitamin D levels. Failure to correct vitamin D deficiency can lead to metabolic syndrome, a collection of heart disease risk factors that increase the chances of heart disease, stroke, and diabetes. Physicians and other health care providers can test to see if you are vitamin D deficient by checking your blood levels. IRON Studies have proven a positive correlation between iron deficiency and obesity. Furthermore, studies have also revealed reductions in BMI, body weight, and waist circumference after successful treatment of iron deficiency. Iron also aids in increasing energy levels, which may help increase exercise and result in effective weight loss. If you want to avoid another pill, iron can be found in red meat and a variety of vegetables. Women experience iron deficiency more often than men due to menstruation and therefore require a higher dosage ââ¬â men need 8 mg per day; women need 18 mg per day. Vitamin C is recommended in conjunction with iron supplements to aid in absorption. MAGNESIUM Dr. Friedman notes a number of benefits from magnesium in his book, Food Sanity: How to Eat in a World of Fads and Fiction, Magnesium is an essential mineral, and research suggests it can relax your muscles, help you feel calm, and improve your sleep ââ¬â and all of those things can help you lose weight. A lack of sleep is a key contributing factor to weight gain. Sleep deprivation is a leading cause of the obesity epidemic, and plenty of research supports this notion. If you are suffering from insomnia, it could be due to a magnesium deficiency. People with low magnesium often experience restless sleep, waking frequently during the night. Magnesium plays a role in supporting deep, restorative sleep by maintaining healthy levels of GABA, a neurotransmitter. Magnesium increases GABA and can improve sleep quality. The Womens Hospital in Boston conducted a study that found that poor sleep slows our bodys metabolism and raises our blood sugar levels. Recommended magnesium levels for men are 400 to 420 mg; for women ââ¬â 310 to 320 mg. THE SAFEST BET It is of no surprise that the safest way and the most effective way to lose weight, and keep it off, is by eating a healthy low-calorie diet and being more physically active. There is no magic pill for losing weight. Weight-loss pills, whether they are prescription drugs, nonprescription drugs, herbal products, or some other kind of dietary supplement, are all just stepping stones that may or may not help with weight loss. With that being said, if you think you absolutely need something to jump start your diet, caffeine can be a healthy option. Its safe to start your day with two cups of black coffee ââ¬â no cream and no sugar. This will increase your metabolism. Caffeine releases epinephrine, also known as adrenaline, which helps breakdown fat stored in our body. 100mg of caffeine ââ¬â about one cup of coffee ââ¬â boosts thermogenesis, or calorie burning, for a few hours following consumption. While caffeine does give you an extra boost for calorie burning, it can cau se elevations in heart rate and blood pressure. Because of this, you should contact your doctor or healthcare provider before starting this weight-loss trick, or before using any weight-loss dietary supplements.

On each site, the process is tailored to the specific project and the specific ground conditions. Ground investigations classify the soils beneath the site into broad groups: each group contains soils with similar engineering behaviour. The simplest classification used by engineers divides the ground into five categories: rock, granular soil (e.g. sands or gravels), cohesive soil (e.g. clays), organic soil (e.g. peats) and fill or made ground. From the desk top survey we have found out that the Dagenham area is made up of London clay Clay can be recognised as being smooth and silky to touch with no grains visible to the naked eye. It may also contain silt sized particles (barely visible to the naked eye) together with sand (which will be visible and would give a grittier feel). In general the finer the soil is (more clay particle and less silt or sand sized particles), the greater its shrinkage potential. Ideally, a suitable site investigation should be undertaken to determine the nature and condition of the underlying clay soil. Ground water conditions are significant because they can affect construction in a number of ways: â⬠¢ A high groundwater table can lead to extra costs and make constructions more difficult, e.g. because of the need for increased support andShow MoreRelatedThe Importance Of Comprehensive Site Investigations And Getting The Right Report1351 Words à |à 6 PagesThe importance of comprehensive site investigations and getting the right report, and by an EPA accredited auditor can be seen in the court case Charben Haulage Pty Ltd v Environmental Earth Sciences Pty Ltd (2004) FCA 403. The Story of a Novel For 50 years, Harper Leeââ¬â¢s novel To Kill a Mockingbird has been recognized worldwide as a classic. It has never been out of print, which is just one of the many signs that prove how imprinted into our society it is. Harper Lee changed the way readers experience the world around them, and certainly raised the bar for what should be expected from classic novels. We will write a custom essay sample on Tkam Essay or any similar topic only for you Order Now To Kill a Mockingbirdââ¬â¢s legacy will be everlasting, for holds a mirror up to America and shows what truly lies underneath. America has always taken pride in its detailed history, for better or for worse. Many novels have attempted to demonstrate historical events, but none have quite come close to the outstanding perspective of To Kill a Mockingbird. Readers get to see America as it was in the 1930ââ¬â¢s through the eyes of an untainted, unhindered child. As it has always been told, sadly, racism and prejudice were somewhat of a building block for the founding of this country. The audience experiences this firsthand in the novel as Atticus Finch, a middle-aged lawyer, takes on a case in which he must defend a black man accused of raping a white woman. Circumstantially, the cause for this case would be lost; the black man would be found guilty upon being seen by the jury. As even Reverend Sykes stated, ââ¬Å"[he] had never seen any jury decide in favor of a colored man over a white manâ⬠(279). But Atticus, an entrepreneur of his own kind, defied the accepted truth and caused the jury to ponder for hours. This was an important moment for both literature and for the well-being of America. It puts into perspective the hardships of African Americans during the 1930ââ¬â¢s, which is not something to be taken lightly. Every society has their own mind set of what they consider to be ââ¬Ëideal. ââ¬â¢ For example, Americanââ¬â¢s could be loyal, truthful, and courageous; this almost perfectly describes Atticus. Even though obstacles may make his aspirations difficult, he did not stray; he kept pushing forward no matter what. Also, he is the utter definition of what the justice system, a major part of the American lifestyle, is meant to be. It is against his morals to tell anything but the whole truth, to fabricate any circumstance, and to treat any given person as anything but equal. He attempts to change the tarnished views of jury members, which could be seen as a spark for African American rights. Lastly, Atticus is the advocate for courage. As he stated himself, ââ¬Å"[courage] is knowing youââ¬â¢re licked before you begin but you begin anyway and you see it through no matter whatâ⬠(149). There is a slim possibility of achieving your goal, but itââ¬â¢s that chance that makes all the difference. He has been an inspiration and an American icon for countless amounts of people, which is one of the major reasons that have made To Kill a Mockingbird so widespread. A common factor for many classic novels is their ability to be related to. For instance, it would be easier for the reader to relate to a character going through turbulences in their lives than it would be the same person to relate to an old man fighting in an apocalypse. For this reason, it nears impossible to deny how much of a classic To Kill a Mockingbird is. Firstly, Scout is extremely relatable because itââ¬â¢s safe to say most everyone can reminisce to a time when they were innocent, naive to hardship and struggle, and curious about the adult world. One of the universal languages is youth, which is something everyone has had to go through. Second, you will seldom find a person who has not gone through a confusing, complicated period in their life. We experience this with Jem; as he grows and matures, he begins to see the world through different eyes. The only catch is his vision is blurry, which is what confuses the situation. Lastly, practically everyone has gone through a time where the difference between right and wrong is undefined. Atticus has to decide whether to tarnish one moral or another- to lie and say Arthur Radley didnââ¬â¢t kill Bob Ewell, or to expose him to the world and ultimately kill a mockingbird. For 50 years, To Kill a mockingbird has been looked up to and studied by millions across America, and even across the world. It is one of few novels that can say they have never gone out of print, which is an astonishing accomplishment. Harper Lee touched the hearts of many, and showed readers what it really means to be an American. For these reasons, To Kill a Mockingbird will continue to prosper for endless generations to come.
